Workplace Standards Changes due to COVID-19

The recent pandemic has led to many temporary laws being passed which provide assistance in this time of crisis, particularly regarding special leave for employees impacted by COVID-19.

These laws change rapidly as more information becomes available and public health officials make new recommendations, and are different in each jurisdiction. Please consult the appropriate government sources for up-to-date information on this issue.


Employment Standards

Minimum Wage $14.25/hour
$11.40/hour for employees receiving tips
Hours of Work

Overtime after 40 hours/week
3 Hours call-in
Minimum of 32 consecutive hours of rest per week
Employees receive a 30 minute break after 5 hours

26 weeks/year unpaid for donation/transplanting of organs
26 weeks/year unpaid domestic/sexual violence leave
36 weeks unpaid critical illness leave to care for a child, 16 weeks unpaid to care for an adult, OR 27 weeks for potentially fatal illness and up to 104 weeks for fatal illness of a child
The first two days per year from any of the following combined are paid leaves of absence: to act as a caregiver for someone, sickness, organ donation, domestic violence, or if they are the victim of a crime
104 weeks in case of disappearance or death of a child
26 weeks for non-work-related long-term illness or injury

Temporary Lay-Offs &
Group Terminations
Temporary lay-off for up to 6 months
Terminations of 10 or more employees within 2 months in the same establishment must give advance notice to the Minister of Labour, Employment and Social Solidarity, CNESST, and any affected employees and unions, based on the number of employees terminated: 8 weeks for 10 or more, 12 weeks for 100 or more, and 16 weeks for 300 or more
